These Terms are between you and The Pool (UK) Limited ("The Pool", “we” or "us") and they govern our respective rights and obligations and the terms of your subscription to the Editor’s Circle, a monthly newsletter subscription service provided by us.

We are registered in England and Wales under number 09070050. Our registered office is at 1st Floor, Epatra House, 58-60 Berners Street, London, W1T 3NQ. Our VAT number is 198462557.

These Terms, together with the applicable terms and conditions related to any promotional offers provided to you within the Editor’s Circle newsletter, constitute the entire agreement between you and us relating to your Editor’s Circle subscription.

Please note that your Editor’s Circle subscription is also governed by The Pool’s privacy policy which can be found here, which (as changed over time) is incorporated into these Terms.

Please read these Terms carefully.

How do I become a subscriber?

To become a subscriber of Editor’s Circle, please visit the-pool.com/editors-circle. Any resident of any country may subscribe to Editor’s Circle, although we reserve the right to exclude certain territories from time to time or limit the entitlements, benefits and promotions on offer in any country. Your subscription contract with us will be concluded once you receive an email confirmation of your Editor’s Circle subscription.

By registering to become a subscriber, you agree that you have given us accurate registration details, including payment information and will ensure that we always have up to date contact information as and when they change.

What does the subscription cost?

The costs of the subscription shall be made clear to you on our sign-up pages and in your welcome email. We may vary the price of the subscription in the future, but we will always inform you of this in advance and offer you the opportunity to cancel your payment if you do not wish to pay the new price.

Once you order the service, your subscription to the service will automatically renew on a monthly basis (on the day of the month on which you made the first payment) until you cancel your service by logging into your profile on the website and unticking the ‘Editor’s Circle’ option within your “My Profile” “manage email subscription” section.

You must cancel your subscription before your billing day for each monthly period in order to avoid being automatically charged for the next month’s period of service fee.

You can pay using all major credit and debit cards and all such payments will be subject to validation checks and authorisation by the card issuer. If the issuer of your card refuses to authorise payment to us, then we will not be able to confirm your order and no contract will exist between us.

How do I cancel my subscription?

There is no long term commitment and you may cancel your subscription at any time by logging in and accessing “My Profile” or you can email us at editors.circle@thepoolltd.com and we will do it for you. If you cancel your subscription within the first 14 days and have not taken advantage of any Editor’s Circle benefits we will refund your subscription fee in full. If you cancel, your subscription and entitlement to any Editor’s Circle Benefits will cease at the point that you cancel.  Please note that if you do decide to cancel after the 14 day initial period, we will not provide refunds or credits for any partial subscription periods or any unused benefits.

●      We reserve the right to accept or refuse subscriptions in our discretion.

●      You may not transfer or assign your Editor’s Circle subscription or any Editor’s Circle benefits, including any promotion codes, except as allowed in these terms.

●      Editor’s Circle subscribers are not permitted to purchase products for the purpose of resale, rental, or to ship to their customers or potential customers using Editor’s Circle benefits.

●      From time to time, we may choose in our sole discretion to add to, remove or amend subscription benefits.

●      Subscription to Editor’s Circle is only available to end consumers for private use and is not available for corporate accounts, legal entities or for customers who purchase items for business or institutional use or for the purpose of resale.

We sometimes offer certain customers various trial or other promotional memberships, which are subject to these Terms except as otherwise stated in the promotional offers. Trial members may at any time choose not to continue to pay for the subscription amount at the end of the trial period.

We may in our discretion amend these Terms at any time to ensure that we remain compliant with relevant laws and regulations and to ensure that we are constantly improving your subscription experience. If we make any important changes to the subscription terms we will notify you in writing. Please note that your continued subscription after any change constitutes your acceptance of the change. If you do not agree to any change, then you must cancel your subscription.

We may terminate your Editor’s Circle subscription at our discretion without notice. We will not give any refund for termination related to conduct that we determine, in our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Editor’s Circle’s subscription and benefits, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

We will not be liable for: (a) any economic losses (including loss of revenues, profits, contracts, anticipated savings, data or wasted expenditure; (b) any loss of goodwill or reputation; (c) any other indirect or consequential loss; and (d) any third party provider that refuses to honour the advertised promotion or discount.
